Terms of Service

01 - General Terms

• Prices are subject to change based on demand.

• I have the right to reject any order for any reason.
   

02 - Payment

• All pricing is listed in USD and is to be paid via PayPal.

• Commissions can be paid either 100% upfront or split 50% upfront and 50% after finished work is approved. (Watermarks will be added as a safety precaution during production for myself and you, the commissioner, in case of theft.) 

• Payment is required upon receipt of invoice. Invoices will be sent once a commission slot has been confirms and the terms of which have been agreed upon.
   

03 - Process & Delivery

• ​The time it takes to finish your commission varies 1 week to 3 weeks depending on factors such as health, the complexity of the commissioned piece and other obligations.

• Upon completion of the commission and receipt of payment, you will receive full resolution image(s). Please note that no physical product will be provided. By default, commissions are provided in JPG format. If you require a different format, please make sure to state so in your request.
   

04 - Revisions

• Each commission includes up to three (3) rounds of revisions.

• Revisions past the third set will be charged at a rate of ($50/hr)
   

05 - Copyright & Usage

• I, "Obsidian Lantern" (the artist):

  • I reserve the right to cancel and refund the order at any time for any reason.

  • I retain all copyrights over the commissioned artwork.

  • I will NOT claim the intellectual property (IP) of the commissioned artwork (your characters are still yours, etc.)

  • I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.

  • I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books unless specified by the commissioner.

• You (the customer/commissioner):

  • You may upload the commissioned artwork on any website and social channels.

  • You may NOT make profits from the commissioned piece (reselling, redistributing, making prints for selling, etc.) unless given consent by me (the artist).

  • You may NOT alter the commissioned artwork without my (the artist's) consent.

  • You retain the rights to the intellectual property (IP).

  • You may NOT use the commissioned artwork for commercial purposes unless given consent by me (the artist). 

• The following is considered copyright infringement:​

  • Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.

  • Claiming the artwork as your own

  • Altering the artwork without my consent

• In some cases, the commercial rights to the image may be purchased. Please contact me for further information. 

• Under no circumstances is the piece to be used with AI, both for alteration or for training purposes!!!
   

06 - Cancelation & Refund policy

• Refunds are not available once I have begun working on the commission unless:

  -  I am unable to start the commission.
  - If the order is cancelled before work has begun.
   

Paypal specific:

• If a refund is required, please do not request a chargeback. I will manually transfer the money back to the account it was initially paid from.

• If you request a chargeback when a refund is denited, you forfeit all rights to the commission and I have the right to profit on the piece in any way (besides claiming IP rights). The chargeback will be designed and I will supply PayPal with all evidence that work was completed per the terms of the commission.

• Chargebacks will also result in a blacklist from requesting further commissions.
